Welcome to Brainy Tutor! These Terms of Service ("Terms") govern your access to and use of our tutoring services. By booking a session or using our website, you agree to these Terms.

1. Services Provided
Brainy Tutor provides private, 1:1 online tutoring for students in kindergarten through 8th grade. Sessions are conducted virtually using video conferencing tools (e.g., Zoom).

2. Eligibility
By using our services, you affirm that:
- You are a parent or legal guardian of the student being tutored
- You are at least 18 years old and capable of entering into this agreement
- You consent to the collection and use of information as described in our Privacy Policy

3. Booking & Payment
- Sessions must be scheduled in advance via our booking system (Tally + Calendly)
- Payment is processed securely through Stripe and is required to confirm your session - All payments are non-refundable once a session has been completed

4. Cancellation & Rescheduling
- Sessions must be canceled or rescheduled at least 24 hours in advance
- Cancellations with less than 24 hours' notice may not be eligible for refund or credit - Missed sessions without notice are considered forfeited
- If your child is late, the session will still end at the originally scheduled time

5. Refund Policy
Refunds are not available for completed sessions. If a session is canceled in accordance with our policy, we may offer a credit toward a future session at our discretion.

6. Academic Disclaimer
Brainy Tutor aims to support student growth, but we do not guarantee specific academic results or improvements. Learning outcomes vary based on many factors, including student participation, consistency, and external support.

7. Code of Conduct
To ensure a productive learning environment, students are expected to:
- Arrive on time, prepared, and focused
- Use respectful language and behavior
- Avoid distractions (e.g., texting, games, unrelated websites) during sessions Repeated misconduct may result in removal from tutoring services without refund.

8. Technology Requirements
Since tutoring is conducted online, families are responsible for ensuring:
- A reliable internet connection
- A device with a working webcam and microphone
- A quiet, distraction-free environment for learning
We are not responsible for lost instructional time due to technical issues on the student's side.

9. Data & Privacy
By using our services, you agree to our data collection and use practices as outlined in our Privacy Policy. We comply with COPPA and will not collect personal information from students under 13 without verified parental consent.

10. Termination of Services
We reserve the right to suspend or terminate services at our discretion due to policy violations, repeated no-shows, or inappropriate behavior.

11. Changes to These Terms
We may update these Terms at any time. We'll notify you of significant changes via email or on our website. Continued use of our services after changes means you accept the updated Terms.
